NOTICE OF OBJECTION under Section 104 (2) of the Licensing Act 2003

 

To whom it may concern,

 

Notice of objection is hereby given on behalf of the Chief Officer of Police for Sussex for the above Temporary Event Notice (TEN) on the grounds of the licensing objective of prevention of crime and disorder and public nuisance not being promoted.

 

The TEN seeks to licence the following:

 

We are unsure but believe this is for Late Night refreshments: Wednesday 31st Dec 2025 23:00 through to Thursday 01st January 2026 05:00.

 

The venue is described as a restaurant / takeaway. The applicant describes the event as being New Years Eve into New Years.

 

Sussex Police work closely with venues in the city centre, particularly around dates and times which may see a higher demand for policing e.g. Bank Holidays, Pride, Halloween, and New Years to name a few. During Brighton & Hove Pride 2025 the venue operated under a TEN which permitted them to conduct late night refreshments until 02:00 during the weekend. Although it should always be expected for venue operators to act responsibly day to day, we do put an additional emphasis during high-risk peak times. At 03:45 on 03rd August 2025 officers attended the venue as it was open with customers inside awaiting food orders. This being when the venue should have closed by 02:00. The staff became dismissive towards the officers stating they had no customers despite them physically being in the shop waiting for their orders and confirming to officers that this was the case.

 

The previous breach of a TEN does not give us confidence to support this new notice for New Years Eve.

 

Additionally, we have concerns around crime & disorder and public nuisance. Within the notice there is no safeguarding information given regarding vulnerable people which could be a factor especially that time of the year. There are also no security arrangements in place that they are making us aware of. The notice is to trade until 05:00 which does not assist with dispersal from this area. An area which although has many types of businesses is also very residential. Keeping people in the location until this time is likely to cause anti-social behaviour by way of noise causing a public nuisance.

 

The premises is unlicensed, so we do not benefit with the knowledge that the venue has CCTV, incident logs and staff training especially around vulnerability and conflict management. Safeguards that are often put on licensed venues.

 

The Chief Officer of Police contends that permitting this location to be used in accordance with the notice is likely to undermine the licensing objectives, particularly at a high-risk period e.g. the early hours of the morning during New Years and the non-compliance of the TEN during Pride 2025. For these reasons, we ask that a Counter Notice is issued by the Licensing Authority Committee.
